Political
actors increasingly question the efficacy of the existing framework for
election dispute resolution in Nigeria. Critics say that it is tilted more
towards fortifying the position of the victor than to the promotion of justice.
Opposition parties were hesitant to file election petitions after the 2003
polls, campaigning instead for a blanket cancellation of the results. Such
lack of faith could incline candidates to pursue every means possible to
achieve victory, with negative consequences for the democratic process.
IDEA has initiated an Election Dispute Resolution (EDR) project to assess the effectiveness of dispute tribunals in Nigeria. This is a three-phase endeavour. It began in April with an assessment of election legislation in Nigeria, especially of the existing legal framework for resolving election disputes. The second phase involves a survey of election laws and cases decided by the tribunals vested with the legal authority to adjudicate election petitions. This phase should highlight how the law plays out in practise and the weaknesses that need to be addressed. At the conclusion of this phase, the findings of the first two phases will be condensed into a user-friendly format for dissemination to key stakeholders for further discussion and reflection. The third phase will involve a national workshop of key stakeholders to make recommendations for the reform of the EDR framework in a way that enhances the credibility of the electoral process and the democratic transition. It is hoped that the initiative will provide a platform based on facts and findings for interventions to improve the country’s EDR framework. IDEA’s EDR project will entail a global survey and
development of case studies and comparative texts, including the production
of a Handbook and related materials in 2004 and 2005.
